Welcome to Your Billboard Online (YBO)! These Terms of Service ("Terms") govern your use of our services. By accessing or using our services, you agree to be bound by these Terms.



1. Services Provided

YBO offers a suite of services designed to enhance your business's visibility and streamline customer engagement, including:

-Web Design: Creation of custom websites tailored to small businesses, optimized for mobile, conversion-focused, and optionally integrated with automation features. All websites are hosted by YBO unless otherwise agreed upon. Ongoing updates and maintenance are included in the monthly hosting fee.

-Digital Advertising: Creation and management of paid advertising campaigns on platforms such as Facebook, Instagram, and Google. Campaigns are optimized for reach, leads, and ROI with ad spend budgets set by the client.


-Marketing Automation: Implementation of automated workflows such as lead nurturing, appointment reminders, missed call text back, chatbot responses, loyalty programs, and review requests.

-SMS Communication: Sending SMS messages for appointment confirmations, reminders, follow-ups, and lead responses. All SMS usage complies with carrier regulations and applicable laws.

-CRM Integration: Setup and integration of Customer Relationship Management systems (typically GoHighLevel), giving clients the ability to manage leads, messages, reviews, appointments, and automations in one place.

-Analytics and Reporting: Insightful performance tracking for websites, ad campaigns, automations, and customer interactions, provided via dashboards or reports.


2. Payment & Refund Policy

-Project Based Services (e.g., Website Builds):
A deposit may be required upfront. Final payment is due before project delivery unless otherwise arranged.

-Ongoing Services (e.g., hosting, automation, ad management):
Billed monthly via recurring invoice or autopay. Payments are due at the beginning of each billing cycle.

-Refunds:
Payments are non-refundable once services begin. In rare cases where YBO cannot deliver a paid-for service due to internal fault, partial refunds may be issued at our discretion.

2A. ROI Challenge Terms

From time to time, YBO may offer a promotional marketing campaign called the ROI Challenge, in which businesses pay an entry fee (currently $500) and YBO commits to generating at least $1,000 in new revenue over a five-week period.

By participating in the ROI Challenge, you agree to the following conditions:

-Ad Spend Cap: $250 of the $500 entry fee is allocated toward paid advertising. This amount is non-refundable under all circumstances.

-Refund Eligibility: If the campaign fails to produce at least $1,000 in attributable revenue, you may request a refund of the remaining $250 within 7 days of the campaign’s conclusion.

-Lead Conversion Responsibility: YBO will generate leads and/or initiate customer engagements, but it is your responsibility to respond to inquiries, close sales, and convert leads into paying customers. Revenue is calculated based on verifiable completed transactions.

-Proof of Revenue: You may be required to provide basic documentation (e.g., sales receipts or service confirmations) to validate the campaign’s outcome.

-Single Use: The ROI Challenge is limited to one participation per business or brand.

Participation in the ROI Challenge does not guarantee business success and should not be interpreted as a promise of profit. You accept that digital marketing outcomes may vary depending on your industry, responsiveness, and market conditions.



3. Advertising Performance Disclaimer

Marketing results can vary based on numerous factors, including industry, budget, competition, and audience engagement. While we strive to create effective ads, we do not guarantee specific levels of leads, conversions, or revenue increases. By using our services, you acknowledge that YBO is not responsible for:

-The performance of your ad campaign.

-The actions of leads or customers generated from your ads.

-Any changes in ad performance due to updates in platform algorithms.



4. Client Responsibilities

To ensure the best possible advertising results, you agree to:

-Provide accurate business details when submitting your form.

-Ensure your business complies with advertising guidelines set by Facebook, Instagram, and other platforms.

-Respond to leads/customers generated by your ads in a timely manner for best results.

If your provided information is misleading, false, or violates platform policies, we reserve the right to cancel your campaign without a refund.

-Provide timely access to necessary content, logins, or platform permissions.

-Approve design drafts, campaign content, or automation flows in a timely manner.

-Use services in compliance with federal, state, and platform-specific advertising policies.



5. SMS Consent & Compliance

By opting into our SMS services, you consent to receive text messages from YBO or on behalf of your business. Message and data rates may apply. Frequency varies. You may opt out at any time by replying "STOP."

You agree to only use SMS messaging with contacts who have explicitly opted in. YBO is not liable for misuse of messaging services that violate federal laws (e.g., TCPA) or carrier guidelines.



6. Limitations of Liability

To the fullest extent permitted by law, YBO is not liable for:

-Any indirect, incidental, or consequential damages.

-Loss of profits, revenue, or data resulting from ad campaigns.

-Any downtime or issues related to third-party platforms (e.g., Facebook, Instagram).

-Errors due to incorrect information provided by the client.

If a dispute arises, our total liability is limited to the amount paid for the affected service.


7. Intellectual Property

Custom websites, automations, and ads created by YBO remain the intellectual property of YBO unless transferred explicitly in writing. Clients are granted a license to use these assets while paying for services. If services are canceled, access to proprietary tools, portals, or software may be revoked.


8. Confidentiality

YBO will maintain the confidentiality of client information and never share or sell client data. All proprietary business and marketing strategies will remain private and secure unless disclosure is legally required.



9. Governing Law

These Terms are governed by the laws of North Carolina, without regard to conflict of law principles. Any disputes shall be resolved through arbitration or small claims court in Madison County, NC.



10. Changes to These Terms

YBO may update these Terms at any time. Changes will be posted on our website. Continued use of services implies acceptance of updated Terms.
